TERMS & CONDITIONS and RESPONSIBILITY

*As a condition to acceptance of this application and participation in this workshop, EACH applicant must sign the following statement (parent/legal guardian must sign for each child).

Payments, Cancellations, and Refunds: Full payment is due upon registration. All cancellation notices must be received in writing and will become effective as of the date of the postmark.  Per-person charges for cancellations that occur between 30 - 45 days prior to workshop: 50% of the workshop cost; 29 or fewer days prior to workshop: 100% of the workshop cost. We reserve the right to cancel any workshop because of inadequate enrollment that makes the workshop economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. Fancy Girl Street Boy Productions will provide you with a full refund if a workshop is cancelled.

Itinerary Changes: The itineraries and staff presented in this brochure are subject to modification and change by Fancy Girl Street Boy Productions. Every reasonable effort will be made to operate programs as planned, but alterations may still occur after final itineraries are sent.

Health Requirements: You must be in good physical and mental health. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made.

Allergies and Special Dietary Requests: Please be advised that food and beverage locations are not owned or operated by us. For food and beverage offerings arranged by us, we use reasonable efforts to communicate special dietary requests to the locations and, for pre-packaged retail food and beverage, we rely on supplier/manufacturer ingredient labels. Please contact us so you can make an informed choice because food preparation processes and menus vary by location. You are responsible for deciding whether any particular offering meets your requirements. We cannot guarantee that any offering is completely free of allergens.

Photography: We reserve the right to take photographs or videos during the operation of any workshop or part thereof and to use the resulting photography, videos, or recordings for promotional or commercial use. By taking this workshop, the participant agrees to allow his/her likeness to be used by Fancy Girl Street Boy Productions without compensation to the participant. If the participant prefers that his/her likeness not be used, he/she must notify us in writing prior to the workshop. Copyright in all photographs, video, and related materials created by the participant ("Workshop Materials") shall belong to the participant upon creation.

Responsibility: You are advised to carefully read the details of your selected itinerary before booking a Workshop to understand the activity level and requirements, including the list of Activities. Certain itineraries may not be suitable for all Participants, including Participants with disabilities, due to terrain/local conditions, the nature of the Activities, or otherwise. While we do everything we can to make our Workshops accessible, our staff may not be able to physically assist Participants who need or may need assistance during the Workshop or with respect to any Activity. All Participants are strongly encouraged to consult with their personal physician before booking a reservation. Please contact us about specific itineraries or Activities. By registering for a Fancy Girl Street Boy Workshop, the Participant certifies that he/she/they does/do not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other Participants. Fancy Girl Street Boy Productions reserves the right in their sole discretion to accept, decline to accept, or remove any Participant in a workshop. Fancy Girl Street Boy Productions reserves the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of Participants. Neither Fancy Girl Street Boy Productions nor their staff shall be liable for any air carrier's cancellation penalty incurred by the purchase of a nonrefundable ticket to or from the participant's departure city. Baggage and personal effects are at all times the sole responsibility of the participant. You are solely responsible for obtaining any documents required for your participation on the Workshop such as a valid passport, all visas, vaccination certificates, and any other documents which may be required by your itinerary or as required for traveling with minors, and complying with any destination specific requirements or restrictions. 

Agreement of Participation for The Mermaid Parade Workshop

I have read the schedule of activities for this trip and recognize and accept the risks thereof.  I have read and agree to the TERMS & CONDITIONS and the RESPONSIBILITY statement (attached) and understand that they include a release of liability that will be binding upon myself and my family, heirs, and legal representatives. I further agree to release Ari Espay, Fancy Girl Street Boy Productions/Liza Politi Photography, LLC, and its designated employees, staff, representatives and agents harmless from any and all liability, loss, or damage that may arise out of my participation in the workshop. By my signature below, and in consideration for being allowed to participate in the Workshop, I hereby acknowledge and agree, for myself, and on behalf of my heirs and personal representatives, as follows:

1.)    In connection with The Mermaid Parade Photography Workshop (the “Workshop”), Ari Espay, Fancy Girl Street Boy Productions/Liza Politi Photography, LLC, together with its officers, directors, employees, staff, representatives and agents (collectively, “Fancy Girl Street Boy Productions”), will not have and does not assume any liability or responsibility for any injury, sickness, damage, loss, expense, delay, accident or irregularity relating to or arising in connection with any transportation, lodging, dining or other travel or living arrangements, including any involving any airplane, ship, motor coach, train or other conveyance, used or involved in carrying out the arrangements of the Workshop.  Fancy Girl Street Boy Productions will not have and does not assume any liability or responsibility for, or for any injury, damage, losses or expenses arising from or in connection with, without limitation, delay or changes in air or other services, sickness, weather, strike, war, terrorism, quarantine, acts of God, Force Majeure, or other causes beyond the control of Fancy Girl Street Boy Productions.  All such losses or expenses will be borne in full by me.

2.)    I assume all the risks of participation in the Workshop, and hereby unconditionally and irrevocably waive all claims and rights or causes of action I might have against, and agree to hold harmless, Fancy Girl Street Boy Productions, and all other persons and organizations having any part in the organization and conduct of the Workshop, for any injury, sickness, damage, loss or expense of any kind or nature that I may suffer or incur as a result of or in connection with my participation in the Workshop.  I certify that I am in proper physical condition to participate in the Workshop, and that if I am not at least eighteen years old my parent/legal guardian has signed this waiver on my behalf. I understand that instructors may not possess the required training or equipment to handle incidents that may occur. In case of injury, accident, illness, or my inability to complete these activities, I will bear the full cost of any additional transportation or evacuation procedures performed by FGSB or its instructors.

Fancy Girl Street Boy Productions reserves the right to make alterations to the Workshop and/or to cancel the Workshop. Fancy Girl Street Boy Productions also reserves the right in its sole discretion at any time to decline to accept or to decline to retain me or any other person as a participant on the Workshop.
